71 NORMAS LEGALES Viernes 23 de junio de 2017 El Peruano / través de sus respectivos representantes debidamente autorizados, han suscrito esta Enmienda No. Nueve en sus nombres y la han otorgado en el día y el año que aparecen en la primera página. AMENDMENT No. NINE, dated _________, between the United States of America, acting through the United States Agency for International Development (“USAID”), and the Republic of Peru (“Grantee”): WHEREAS, the Grantee and USAID entered into Assistance Agreement 527-0426 dated September 20, 2012 (the “Agreement”); WHEREAS, the Grantee and USAID amended the Agreement on July 19, 2013 (Amendment No. One), on September 21, 2013 (Amendment No. Two), on August 26, 2014 (Amendments No. Three and No. Four), on September 30, 2014 (Amendment No. Five), on January 21, 2015 (Amendment No. Six), on September 30, 2015 (Amendment No. Seven), and on September 8, 2016 (Amendment No. Eight); WHEREAS, USAID agreed to grant to the Grantee, subject to the availability of funds, a total estimated contribution of Three Hundred Seventy-Five Million United States Dollars ($375,000,000) to be provided in increments under the terms of the Agreement, of which Three Hundred and Three Million Three Hundred Sixty-Seven Thousand Four Hundred Seventy-Seven United States Dollars ($303,367,477) have been previously granted; and WHEREAS, the Parties through this Amendment No. NINE desire to amend the Agreement to: (a) Pursuant to ARTICLE 3 Section 3.1(a), increase the amount granted to date by USAID in the amount of Forty-Six Million Three Hundred Fifty Thousand United States Dollars ($46,350,000); (b) Adjust the Grantee’s contributions pursuant to ARTICLE 3 Section 3.2(b); (c) Modify the Illustrative Financial Plan attached as Table 1 of the Agreement; and (d) Amend the Completion Date of the Agreement to December 31, 2019. THEREFORE, the Parties hereby agree to amend the Agreement as follows: 1. The text of ARTICLE 3, Section 3.1(a) is hereby deleted in its entirety and replaced with the following:(a) The Grant: To help achieve the Goal and Development Objectives set forth in this Agreement, USAID, pursuant to the Foreign Assistance Act of 1961, as amended, hereby grants to the Grantee under the terms of the Agreement the amount of Three Hundred Forty-Nine Million Seven Hundred Seventeen Thousand Four Hundred Seventy-Seven United States Dollars ($349,717,477) (the “Grant”). 2. The fi rst sentence in Section 3.2 (b) (Grantee Contributions) is deleted in its entirety and replaced with the following text: “The total Grantee’s contribution, based on USAID’s contribution in Section 3.1(a), is expected to be at least Eighty-Three Million Seven Hundred Ninety Thousand Three Hundred Twenty-Eight United States Dollars ($83,790,328) as re fl ected in Table 1.” 3. The Illustrative Financial Plan contained in Table 1 of the Agreement is hereby deleted in its entirety and replaced with the Illustrative Financial Plan attached to this Amendment as Table 1. 4. ARTICLE 4 of the Agreement is hereby modi fi ed by deleting “September 30, 2017” and substituting with “December 31, 2019.” Except as expressly amended or modi fi ed in this Amendment, all terms and conditions of the original Agreement remain in full force and effect.
