AMENDMENT No. NINE, dated 29 SET. 2015, 2015, between the United States of America, acting through the United States Agency for International Development ("USAID"), and the Republic of Peru ("Grantee"): WHEREAS, the Grantee and USAID (the "Parties") entered into the Assistance Agreement 527-0423 dated September 29, 2008 (the "Agreement"), as subsequently amended on September 21, 2009 (Amendment No. One), on September 30, 2009 (Amendment No. Two), on June 23, 2010 (Amendment No. Three), on September 29, 2010 (Amendment No. Four), on June 2, 2011 (Amendment No. Five), on September 26, 2011 (Amendment No. Six), on April 26, 2013 (Amendment No. Seven), and on August 26, 2014 (Amendment No. Eight). WHEREAS, the Parties, through Amendment No. Eight, extended the Completion Date of the Agreement to September 30, 2015; and WHEREAS, the Parties through this Amendment No. Nine desire to amend the Completion Date of the Agreement to December 31, 2016. This extension is specifically needed to permit USAID to make full use of remaining resources in approved activities under the Environment Program Area of the Agreement. NOW THEREFORE, the Parties hereby agree to amend the Agreement as follows: ARTICLE 4 of the Agreement is hereby modified by deleting "September 30, 2015" and substituting "December 31, 2016." Except as expressly amended or modified in this Amendment, all terms and conditions of the original Agreement remain in full force and effect. Convenio de Donación de USAID No. 527-0423 USAID Assistance Agreement No. 527-0423 ENMIENDA No. NUEVE AMENDMENT No. NINE AL TO THE CONVENIO DE DONACION ASSISTANCE AGREEMENT ENTRE BETWEEN LOS ESTADOS UNIDOS DE AMERICA THE UNITED STATES OF AMERICA Y AND LA REPUBLICA DEL PERU THE REPUBLIC OF PERU Fecha: 29 SET. 2015 Date: ENMIENDA No. NUEVE de fecha 29 SET. del 2015, entre los Estados Unidos de América, representado por la Agencia de los Estados Unidos para el Desarrollo Internacional ("USAID"), y la República del Perú ("Donatario"): POR CUANTO, el Donatario y USAID (las "Partes") celebraron el Convenio de Donación 527-0423 el 29 de setiembre del 2008 (el "Convenio"), el mismo que fue posteriormente modificado el 21 de setiembre del 2009 (Enmienda No. Uno), el 30 de setiembre del 2009 (Enmienda No. Dos), el 23 de junio del 2010 (Enmienda No. Tres), el 29 de setiembre del 2010 (Enmienda No. Cuatro), el 2 de junio del 2011 (Enmienda No. Cinco), el 26 de setiembre del 2011 (Enmienda No. Seis), el 26 de abril del 2013 (Enmienda No. Siete), y el 26 de agosto del 2014 (Enmienda No. Ocho). POR CUANTO, las Partes, mediante la Enmienda No. Ocho al Convenio, extendieron la Fecha de Terminación del Convenio al 30 de setiembre del 2015; y POR CUANTO, las Partes mediante esta Enmienda No. Nueve desean modificar la Fecha de Terminación del Convenio al 31 de diciembre del 2016. Esta extensión es necesaria para permitir a USAID el uso pleno de los recursos remanentes, en actividades aprobadas bajo el Area Programática de Medio Ambiente del Convenio, exclusivamente. POR CONSIGUIENTE, las Partes mediante la presente acuerdan enmendar el Convenio como sigue: El ARTÍCULO 4 del Convenio es modificado eliminando "30 de setiembre del 2015" y substituyéndolo por "31 de diciembre del 2016." Excepto de lo enmendado o modificado en la presente Enmienda, todos los términos y condiciones del Convenio original permanecen en plena fuerza y vigencia.
