558516 NORMAS LEGALES Sábado 1 de agosto de 2015 / El Peruano (a) La Donación: Para ayudar a alcanzar la Finalidad y Objetivos de Desarrollo establecidos en este Convenio, USAID, de conformidad con la Ley de Asistencia al Exterior de 1961 y sus enmiendas, mediante la presente, otorga al Donatario bajo los términos del Convenio el monto adicional de Diez Millones de Dólares de los Estados Unidos ($10,000,000). El total donado a la fecha asciende a Ciento Ochenta Millones Doscientos Cincuenta y Cinco Mil Cuatrocientos Veintisiete Dólares de los Estados Unidos ($180,255,427), (la “Donación”). Los Diez Millones de Dólares de los Estados Unidos ($10,000,000), se obligan en su totalidad mediante la presente Enmienda Nº Cuatro, incrementando el total de fondos obligados a la fecha bajo el Convenio a Ciento Sesenta y Siete Millones Doscientos Veinte Mil Ciento Veintiséis Dólares de los Estados Unidos ($167,220,126). El total de fondos obligados y administrados por USAID ascendente a Trece Millones Treinta y Cinco Mil Trescientos y Un Dólares de los Estados Unidos ($13,035,301) permanece inalterable. 2. La primera oración de la Sección 3.2(b) (Contribuciones del Donatario) es modifi cada como sigue: “El total de contribuciones esperadas del Donatario, tomando como base la contribución de USAID refl ejada en la Sección 3.1(a), no deberá ser menor a Cuarenta y Dos Millones Seiscientos Cincuenta y Un Mil Novecientos Treinta y Cinco Dólares de los Estados Unidos ($42,651,935), tal como se muestra en el Cuadro 1”. 3. El Plan Financiero Ilustrativo del Convenio contenido en el Cuadro 1 es por la presente anulado en su totalidad y se sustituye por el Plan Financiero Ilustrativo adjunto a esta Enmienda como Cuadro 1. Excepto de lo enmendado o modificado en la presente Enmienda, todos los términos y condiciones del Convenio original permanecen en plena fuerza y vigencia. EN TESTIMONIO DE LO CUAL, la República del Perú y los Estados Unidos de América, actuando cada uno a través de sus respectivos representantes debidamente autorizados, han suscrito esta Enmienda Nº Cuatro en sus nombres y la han otorgado en el día y el año que aparecen en la primera página. Date: 26 AGO. 2014 Codifi cación Contable: Accounting Symbols: Funding Codes: DV 2014/2015 AMENDMENT Nº FOUR, dated 26 AGO. 2014, between the United States of America, acting through the United States Agency for International Development (“USAID”), and the Republic of Peru (“Grantee”): WHEREAS, the Grantee and USAID entered into Assistance Agreement 527-0426 dated September 20, 2012 (the “Agreement”); WHEREAS, the Grantee and USAID amended the Agreement on July 19, 2013 (Amendment Nº One), on September 21, 2013 (Amendment Nº Two), and on 26 AGO. 2014 2014 (Amendment Nº Three); WHEREAS, USAID agreed to grant to the Grantee, subject to the availability of funds, a total estimated contribution of Three Hundred Fifty-Five Million United States Dollars ($355,000,000) to be provided in increments under the terms of the Agreement, of which One Hundred Seventy Million Two Hundred Fifty-Five Thousand Four Hundred Twenty Seven United States Dollars ($170,255,427) have been previously obligated; and WHEREAS, the Parties through this Amendment Nº Four desire to amend the Agreement to: (a) Increase USAID Grant funding pursuant to ARTICLE 3 Section 3.1(a); (b) Increase the Grantee’s contributions pursuant to ARTICLE 3 Section 3.2(b); and (c) Modify the Illustrative Financial Plan attached as Table 1 of the Agreement. THEREFOR, the Parties hereby agree to amend the Agreement as follows: 1. The text of ARTICLE 3, Section 3.1(a) is hereby deleted in its entirety and replaced with the following: (a) The Grant: To help achieve the Goal and Development Objectives set forth in this Agreement, USAID, pursuant to the Foreign Assistance Act of 1961, as amended, hereby grants to the Grantee under the terms of the Agreement an additional amount of Ten Million United States Dollars ($10,000,000). The total amount granted to date is One Hundred Eighty Million Two Hundred Fifty-Five Thousand Four Hundred Twenty Seven United States Dollars ($180,255,427), (the “Grant”). The Ten Million United States Dollars ($10,000,000) are obligated by this Amendment Nº Four in its entirety, bringing the total funds obligated to date under the Agreement to One Hundred Sixty-Seven Million Two Hundred Twenty Thousand One Hundred Twenty Six United States Dollars ($167,220,126). The total funds obligated and administered directly by USAID in the amount of Thirteen Million Thirty-Five Thousand Three Hundred One United States Dollars ($13,035,301) remains unchanged. 2. The fi rst sentence in Section 3.2 (b) (Grantee Contributions) is amended to read as follows: “The total Grantee’s contribution, based on USAID’s contribution in Section 3.1(a), are expected to be at least Forty-Two Million Six Hundred Fifty-One Thousand Nine Hundred Thirty-Five United States Dollars ($42,651,935), as refl ected in Table 1.” 3. The Illustrative Financial Plan contained in Table 1 of the Agreement is hereby deleted in its entirety and replaced with the Illustrative Financial Plan attached to this Amendment as Table 1. Except as expressly amended or modifi ed in this Amendment, all terms and conditions of the original Agreement remain in full force and effect.
