El Peruano Miércoles 3 de junio de 2015 553973 Millones de Dólares de los Estados Unidos ($355,000,000) la misma que será proporcionada en incrementos según los términos del Convenio, de los cuales Setenta y Siete Millones Ochocientos Setenta y Seis Mil Cuatrocientos Setenta y Nueve Dólares de los Estados Unidos ($77,876,479) se han proporcionado previamente; y POR CUANTO, las Partes mediante esta Enmienda No. Uno desean modifi car el Convenio para: (a) Incrementar el monto de la Donación de USAID a la fecha de conformidad con el ARTICULO 3, Sección 3.1(a); (b) Incrementar la contribución del Donatario de conformidad con el ARTICULO 3, Sección 3.2(b); y (c) Cambiar el Plan Financiero Ilustrativo adjunto como Cuadro 1 del Convenio; POR CONSIGUIENTE, las Partes mediante la presente acuerdan enmendar el Convenio como sigue: 1. El texto del ARTICULO 3, Sección 3.1 (a), mediante la presente es anulado en su totalidad y se sustituye con lo siguiente: (a) La Donación: Para ayudar a alcanzar el Objetivo dispuesto en este Convenio, USAID, de conformidad con la Ley de Asistencia al Exterior de 1961 y sus enmiendas, mediante la presente, otorga al Donatario bajo los términos del Convenio el monto adicional de Nueve Millones, Quinientos Once Mil Ochocientos Cincuenta y Seis Dólares de los Estados Unidos ($9,511,856). El total donado a la fecha asciende a Ochenta y Siete Millones Trescientos Ochenta y Ocho Mil Trescientos Treinta y Cinco Dólares de los Estados Unidos ($87,388,335), (la “Donación”). Bajo la Donación, Ocho Millones, Setecientos Sesenta y Un Mil Ochocientos Cincuenta y Seis Dólares de los Estados Unidos ($8,761,856) se obligan mediante la presente Enmienda No. Uno, incrementando el total obligado a la fecha por el Convenio a Ochenta Millones Ochocientos Setenta y Nueve Mil Doscientos Dos Dólares de los Estados Unidos ($80,879,202). El total de fondos obligados directamente por USAID a entidades ejecutoras bajo los términos del Convenio se incrementa por Setecientos Cincuenta Mil Dólares de los Estados Unidos ($750,000), el nuevo total de fondos obligados y administrados por USAID asciende a Seis Millones Quinientos Nueve Mil Ciento Treinta y Tres Dólares de los Estados Unidos ($6,509,133). 2. La primera oración de la Sección 3.2(b) (Contribuciones del Donatario) es modifi cada como sigue: “El total de contribuciones esperadas del Donatario, tomando como base la contribución de USAID refl ejada en la Sección 3.1(a), no deberá ser menor a Diecinueve Millones Doscientos Diecinueve Mil Ochocientos Ochenta y Cuatro Dólares de los Estados Unidos ($19,219,884), tal como se muestra en el Cuadro 1.” 3. El Plan Financiero Ilustrativo del Convenio contenido en el Cuadro 1 es por la presente anulado en su totalidad y se sustituye por el Plan Financiero Ilustrativo adjunto a esta Enmienda como Cuadro 1. Excepto de lo enmendado o modifi cado en la presente Enmienda, todos los términos y condiciones del Convenio original permanecen en plena fuerza y vigencia. EN TESTIMONIO DE LO CUAL, la República del Perú y los Estados Unidos de América, actuando cada uno a través de sus respectivos representantes debidamente autorizados, han suscrito esta Enmienda No. Uno en sus nombres y la han otorgado en el día y el año que aparecen en la primera página. AMENDMENT No. ONE, dated_________, between the United States of America, acting through the United States Agency for International Development (“USAID”), and the Republic of Peru (“Grantee”): WHEREAS, the Grantee and USAID entered into Assistance Agreement 527-0426 dated September 20, 2012 (the “Agreement”); WHEREAS, USAID agreed to grant to the Grantee, subject to the availability of funds, a total estimated contribution of Three Hundred Fifty-Five Million United States Dollars ($355,000,000) to be provided in increments under the terms of the Agreement, of which Seventy-Seven Million Eight Hundred Seventy-Six Thousand Four Hundred Seventy-Nine United States Dollars ($77,876,479) has been previously obligated; and WHEREAS, the Parties through this Amendment No. One desire to amend the Agreement to: (a) Increase USAID Grant funding pursuant to ARTICLE 3 Section 3.1(a); (b) Increase the Grantee’s contributions pursuant to ARTICLE 3 Section 3.2(b); and (c) Modify the Illustrative Financial Plan attached as Table 1 of the Agreement; NOW THEREFOR, the Parties hereby agree to amend the Agreement as follows: 1. The text of ARTICLE 3, Section 3.1(a) is hereby deleted in its entirety and replaced with the following: (a) The Grant: To help achieve the Objective set forth in this Agreement, USAID, pursuant to the Foreign Assistance Act of 1961, as amended, hereby grants to the Grantee under the terms of the Agreement an additional amount of Nine Million Five Hundred Eleven Thousand Eight Hundred Fifty-Six United States Dollars ($9,511,856). The total amount granted to date is Eighty-Seven Million Three Hundred Eighty-Eight Thousand Three Hundred Thirty- Five United States Dollars ($87,388,335), (the “Grant”). Under the Grant, Eight Million Seven Hundred Sixty One Thousand Eight Hundred Fifty-Six United States Dollars ($8,761,856) are obligated by this Amendment No. One, bringing the total funds obligated to date by the Agreement to Eighty Million Eight Hundred Seventy-Nine Thousand Two Hundred Two United States Dollars ($80,879,202). The total funding directly obligated by USAID to implementing partners under the terms of the Agreement is increased by Seven Hundred Fifty Thousand United States Dollars ($750,000) to a new total of Six Million Five Hundred Nine Thousand One Hundred Thirty-Three United States Dollars ($6,509,133). 2. The fi rst sentence in Section 3.2 (b) (Grantee Contributions) is amended to read as follows: “The total Grantee’s contributions, based on USAID’s contribution in Section 3.1(a), are expected to be at least Nineteen Million Two Hundred Nineteen Thousand Eight Hundred Eighty-Four United States Dollars ($19,219,884), as refl ected in Table 1.” 3. The Illustrative Financial Plan contained in Table 1 of the Agreement is hereby deleted in its entirety and replaced with the Illustrative Financial Plan attached to this Amendment as Table 1. Except as expressly amended or modifi ed in this Amendment, all terms and conditions of the original Agreement remain in full force and effect.
